August 16, 2007—ChamberlainD'Amanda partner Carol S. Maue is representing the Canandaigua Lake Watershed Alliance and the Eastshore Association of Canandaigua Lake in a case against RSM West Lake Road LLC. RSM West Lake Road LLC is proposing a 67-home development on West Lake Road on approximately 75 acres of land that includes the German Brothers Marina. The two Canandaigua Lake Protection Groups, the Canandaigua Lake Watershed Alliance and Eastshore Association are appealing Acting Supreme Court Judge Kocher's recent ruling that would overturn a local zoning decision and that would set dangerous precedents for the Watershed, permitting many more boats on Canandaigua Lake than legally permitted in a residentially zoned districts under the Canandaigua Lake Docking and Mooring Law. The decision deprives each lakeshore community of its home rule, depriving the local ZBA's of jurisdiction to review determinations made by their own municipality's zoning officer under the Docking and Mooring Law. It also denies standing to local citizens to appeal improper decisions rendered by a municipality's zoning officer under the Dock Law.
